The two defendants walked away from the agreement, so there is no SIAC for the high court to intervene in. Although I'm sure the court won't look favourably on the former directors behaviour should the case get that far

I think Zheng Zhu will get the stay in their favour just due to how heavily influenced courts are in Singapore with Arb, and if the SPA has arb clause its going back to arb, but I would find it very unlikely they stay for Chong, but she has filed for a stay so lets see.

And yeh if the court refuses the stay for all parties then Zheng Zhu need to file a defence with the counter claims coming in, did someone say Zhengs been saying he's not working on Linked in lol x;) I see a claim for that !

Youre talking as tho arbitration ended, if arbitration ended they could have used the arbitration ruling and enforced it in court, thats if zhneg zhu refused to pay, nothing has been remedied or solved if it had they wouldnt be able stay court proceedings to go back to arb.

Ill say it again mediation is separate to the arb process. and mediation failed, the end. Instead of going back to arb they issued high court writ, fine but now zhneg zhu can take it back to arb and the court will more than likely agree.

Nothing was completed or agreed in that arb process at all.

So why has Chong filed a stay then?

I reckon from next month youre back in arb with Zheng Zhu and in court with Chong.

Funding 2 separate cases

Zheng & Zhu (the two sellers) → High chance of getting a stay on the claims against them.

They are parties to the SPA, which contains the arbitration clause. Singapore courts are strongly pro-arbitration, so Section 6 stay applications by them are usually successful.

Chong Hoi Yan → Claims against her will most likely continue in the High Court.

She was not a party to the original SPA/arbitration agreement, so she cannot be forced into arbitration. Her case is mainly based on alleged breaches of fiduciary duties as a former manager.

Id be surprised if the court stays everyone, partial stay makes sense.

Asking BFD if arb ended in december how can they go back to it ?
