Janice (Wong Shi Hui Janice) is not a Judge. She is an Assistant Registrar of the Supreme Court.What this means for the stay summons hearing:Assistant Registrars in Singapore’s Supreme Court have judicial powers to hear and decide interlocutory applications (such as stay summonses).

They regularly hear and decide stay applications, case management conferences, discovery applications, etc.

Their decisions carry the same weight as a High Court Judge’s decision for that specific matter (unless appealed or reviewed by a Judge).

So in this case:Assistant Registrar Wong Shi Hui Janice was the judicial officer who presided over the stay summons hearings (14 May in chambers and 26 May virtual).

She has the authority to grant or refuse the stay.

Summary:

She is not a full Judge, but she is the one who handled and will decide (or has decided) the stay applications. This is completely normal in the Singapore High Court for this type of procedural matter.

Whoever loses the stays can appeal within 14 days to have oit heard in front of judge.

In the High Court? Or back in Arbitration? Singapore courts love arbitration.

If Zheng and Zhu show there is an arbitration rule in the SPA, and the fight is covered by that rule, then the court will usually say: “Go back to arbitration.”Semnet is only trying to say: “Some parts should stay in the normal court, especially the part about Chong.”

This stay summons hearting is interpreting the clauses in the SPA are separate to what GST and sement are suing for, if Zheng Zhu can prove it relates to the spa, the actual law, not the evidence then it goes back to arb.

Its how the court interprets the lawyers claims, GST have even RNS'd they are pursuing SPA claims int he feb 13th RNS

Partial stay is the worst outcome for you.

In the stay summons hearings (14 May and virtual hearing 26 May), the parties were not arguing about the strength of Semnet’s evidence or the merits of the US$4.2 million claim. That is not what a stay hearing is for.

This was a jurisdictional battle, not a mini-trial.

The key issue is whether the claims (or parts of them) fall inside or outside the arbitration clause in the SPA.

If Zheng and Choo can show that the SPA contains a valid arbitration clause and that the disputes are caught by that clause, then under Singapore law the court must grant a stay (Section 6 of the International Arbitration Act).

Singapore courts are strongly pro-arbitration. This is well-established. If the clause covers the dispute, the claims against Choo and Zheng will almost certainly go back to arbitration. This isnt revolutionary thinking.

Semnet’s job in the stay hearing was mainly to argue that certain claims (especially those against Chong and possibly some fiduciary duty claims) fall outside the scope of the SPA arbitration clause. This is a legal argument on scope and interpretation, not a presentation of smoking-gun evidence on the actual breaches.
