Omega can confirm that it currently has cash balances in excess of £2.5m and an undrawn overdraft facility of £2.0m. they are also in dispute with gov over the repayment of a £2.5m pre production payment,
having spent time reading the contract there are some areas that I could see where the dispute would arise from. there are also reasons why the gov might decide to pursue odx for it
in all likelihood neither party would want to go to court and so an agreement should be reached - which will quite probably cost ODX something. odx will prob want to keep gov doors open no matter how badly they feel they have been treated. so depends on how much both sides are willing to dig their heels in
if it goes to court personally i favour ODX to win
however it is in dispute and with the gov. if you have to pay you cant escape. and so the £2.5m should really be ringfenced for prudent accounting
i suspect the placing is to ensure the company definitely survives whatever happens in the next few months - and of course directors salaries are paid
