it might interest you to check out the cornhill/NEW disciplinary action and fine - for forward selling shares they didn't own. on that occasion they got caught out as placing was cancelled and hence punished.

Anyway tell cornhill that they were fined £300,000 for something they apparently could not do..they may be due a refund!

you say that forward selling cannot happen unless an institution already holds shares. i have never heard this before and with all respect is contradictory to the forward selling practices that I have heard of eg Corn hill and NEW fiasco. where as you say they sold shares they did not own and resulted in a suspension. clearly the companies involved were able to sell shares they did not own

Care to tell me how you deliver to a buyer a share you do not own. that cannot be done, what if the placing is not underwritten or does not go ahead. that would be an illegal move to sell what you do not own.

but isn't that the same principle as shorting? of course the risk is that placing does not go ahead? but then they would have to buy back on open market. however if the placing is guaranteed then there is no risk presumably

by your second paragraph - the directors could sell any shares they held - buy back on an imminent placing..and nobody would know?

DNP - i suspect the selling is a mix of a) those bought as a punt at 7-8p b) those who got it leaked yesterday c) LTH fearing it will go down again so getting out on a spike

if there has been a placing - and i have said i would not be surprised if announced in the next week - then it could have been forward sold as well?
Apparently there are huge volumes - not seen since SP was much higher according to some. of course volume is not an indication that it will be going up to those previous lofty heights...

Forward selling occurs when a company agrees to issue shares to a third party and that third party sells those shares in the market, prior to actually receiving them.

so CE mark can be self certified or approved by an ENB?

previously they were going the latter route and now it would seem they have decided to self certify themselves? which is why they have to submit more data.

curious why they had not done this before?
they will have the required data for CE but not CTDA? different data or just timescale? if timescale why was it not got previously?

is it that this kind of data has been holding up all their approval applications?

market reaction is interesting - clearly leaky yesterday with the rise. market is not convinced by something or else suspects the placing has been suitably primed?

however as usual with odx it is never straight forward i am confused as to why the approval is conditional? and what this means? is this normal?

the eu is the market they need to go for. my only concern has always been they just sign an exclusive deal with dam - who are currently only in spain - this is the easy way out for their poor sales team

the CTDA is not good news - is this odx fault or CTDA?

However the best bit is that the rns was drafted in such a way that the potential bad news was not highlighted - which means they have decided to play the market game. put the required news in but dont highlight it. colin would have written we need further info for CE mark and there is no guarantee that this will be fulfilled.....we could lose everything blah blah ..dont buy a tesla

however - i suspect the odds just went up on a placing. they got the pump they need and the excuse to get away with it.

I raised some questions last night...you just answered yes / no. You keep repeating it as if fact.

The only fact is that there is a dispute...as I said spending the cash does not mean it was authorised.

It will come down to how tight the contract was ...and certain definitions in my opinion

Marik..I have asked you a couple of times for proof of what you are saying is fact...each time you have ignored or tried to divert.

The only fact is that there is a dispute and currently both sides think they have a case. Personally I don't think odx will have to pay..BUT it is not a foregone conclusion and I can see some very clear arguments the gov could use and reasons why they would pursue.

Marik. Just because odx spent the pre production payment doesn't mean it does not have to be paid back.

Depends on what is was spent on and if it is authorised within the contract.

marik - you have to remember that some of us did our due diligence a long way back (it seems) and ODX looked a very rosy opportunity...even as things started to unravel there was always the promise of some other jam tomorrow. kept a lot of people in = lots of money lost

the reality is that odx have messed up everything - well and truly..right royally.

it is very hard to have any more faith in them left. personally my hope is eu approval - as covid is still raging on the continent ...if and it is a big if - they could actually sell something there is still a possible opportunity

realistically no future for private lft in uk - thanks to boris diversion. us is a dead duck with pro use.

EU self test approval is my main hope for ODX.

I think there has been some confusion around funding and submission for FDA and clarification today may have rerated ODX accordingly. Reviewing the comments (from LTH) and the RNS's, we now know that:

i doubt very much if that is the cause of todays rise

could be
1) just market gapping up from drop earlier in week - because the placing has not occurred
2) some news on placing in background
3) news on something else

i really hope it is not a pump before the placing signed off
