If someone told me I would only be paying around 6p premium for a 47-0 PTAB vs the pre PTAB high, I’d have laughed in their face.

Yet here I am, topping up for 36p.

What a crazy place the market is.

Pretty sure Griffiths must still be shifting shares. Mil trade earlier and every meaningful rise being sold back into. Why he’s selling is beyond me but at least it’s being done in an orderly way.

I don’t think the timelines marry up with a delay that could last longer than the patents. Especially as we’ve gone through the PTAB route for that very reason.

Either way I do think it’s a bit of a moot point as an award will take into account lost revenue through licensing, which of course is accruing by the day.

How can the tech not be viable yet we are suing Samsung because they made billions off of it? Talk about a contradiction haha

Good points steak. Maybe just one of my flights of fancy but gut is telling me settlement.

I may be totally barking up the wrong tree here haha. Just can’t help but feel they are having to play other cards here, not just the financial one.

The SP of the mighty Facebook fell 40% when the Cambridge analytica scandal broke. VW shares fell 65% when the emissions scandal broke. In both cases the reputational damage precipitated an epic crash in their SP that went well beyond the purely financial implications. Why? Because in 2022, blue chip firms are held to a higher standard, and loss of trust = loss of value. In a more environmentally and morally aware world than every previous generation, image matters. I genuinely think this is where the world is headed. Big companies can no longer just act with impunity. The internet will see to it that such behaviour is exposed. It’s been proven time and again.

Will Nano be the case that finally bursts Samsung’s bubble? Unlikely? But each time a company like Nano takes on Samsung, Samsung are having to role the dice with their entire reputation at stake. Sooner or later it will really hurt.

I’m going to pin my colours to the mast and say this isn’t getting to court.

Is a totally different PR story to:
‘Now we’ve had all our dirty laundry aired in court, and having been fully dressed down with a landmark ruling, followed by every media outlet in the world, we’ve been slapped with a huge fine’

Samsung is a giant of the industry. But the reputational damage this could cause, is a price I don’t think even Samsung can afford. Why? Context is everything. Companies that get ahead through exploitation and crime are fundamentally at odds with investing in 2022. I don’t mean this in some wishy washy sense, in the age of transparency and readily available information, can Samsung afford an inquest from its shareholders? How many more car crashes of PR can Samsung tolerate before IIs vote with their feet, and the share price comes crumbling down?

You see, Samsung is having to tread such a line here. Going to court, Samsung has an awful lot to lose. I honestly think payout amount is really not what they are worrying about…

The patents are no longer up for debate in court. That is a huge plus for us.

That doesn’t mean to say that Samsung won’t try to argue that they never used the IP in the first place, that they don’t know how to work a jury, that they don’t know how to make Nano seem like a bunch of ‘techno boffins getting their knickers in a twist about some dumb particles that were never worth that much anyway.’ It’s worth bearing in mind samsung have some serious suits representing them. I checked out their CVs on the Kirkland and Ellis website. Heavy hitters with impressive track records, best in class. Whilst we don’t need to fear them, we need to be cautious and prepare ourselves for a few twists and turns in a court case. They will try every trick in the book. You can’t rule out one of those tricks working. After all, at trial, the burden of proof will reside with Nano and Mintz to prove that Samsung stole their IP. This is a totally different ball game to PTAB, and by no means a foregone conclusion.

Let me repeat, I really do not see this getting to court and if it does, it’ll either be for the reasons mentioned above (bearish) or because a Samsung offer was rejected and Nano want their day in court (bullish). I see a win as pretty nailed on but at court, there is part of this that is in the lap of the gods.

A question I myself have considered steak and the only ‘bearish’ argument I can think of is the unknown. Ie by going to court there must surely be some sort of reasonable defence they feel they can mount, presenting evidence we aren’t yet aware of.

I personally don’t see us getting to court to be honest. Pre PTAB I thought a settlement was the likeliest outcome and with the slam dunk in hand I feel even more convinced this will be the case.

Totally agree with your first post there BBD and I think the disconnect between the news and SP can be distilled thus:
- those already invested in Nano are by their very nature venture capitalists. We buy the story, the narrative, and epic growth prospects, and value soft signals as much as hard (financial) ones . That pool of investors alone will not drive the Mcap into a different league.
- the vast majority of retail investors, and to a lesser degree IIs, are not venture capitalists but, like most of the investment world, are driven by hard data and what a company is making.
When tangible financial outcomes materialise, the critical mass of investors will suddenly open up, and true value realised. Until that moment, I’m beginning to learn, we will be staying very much in a ball park far away from true value. The more I think about it, the more the SP makes sense to my contrarian brain.

I doubt it nanogeddon. For sure money flowed in off the back of the transcripts but I don’t think there’s been a leak. The Mcap doesn’t seem to be pricing on any sort of meaningful award at the moment. Simply patience needed.

Yes I did. I got some at 37 and then a few more at 39. I really hope we are congratulating ourself for that decision in a few months Feeks.

I think Hawi is right and am not concerned by day to day price action. It’s clear to me which way this is headed and am sort of grateful it hasn’t gone wild to allow me to top up! Still, for what it’s worth I think the true significance of today is only really understood by the inner circle at this stage, whilst it stays that way it’s a buying op for sure.

I’ve also spent this evening reading through the judgment document. I must say I can decipher even less of this than the transcripts. However, It’s very encouraging to see that not only do they grant the patents, but in their written testimony, compliment the clarity of the patent owner arguments, in addition to really dismantling the Samsung case piece by piece. I can’t see the appeal having much legs to be honest.

Today’s price action has really surprised me. I thought we would have doubled in price today. I would’ve expected 40p just on a split decision, let alone a slam dunk like this! It just goes to show that outside of our little bubble, people don’t really know too much about Nano’s legal battle and the implications of it.

Still, I am assuming most LTHs are being philosophical about it as we are here for the long haul for true value to be realised. Today is a good day.

BTB today is a good day and I think we are on the same page. And I’m not picking a fight. But your posting history on this share chat demonstrates you aren’t being entirely honest with yourself when you say selling ‘freed’ you. If it had, you wouldn’t have been talking this share down the whole time when the signals were pointing the other way. In fact, you’d have been a million miles away from any bulletin board.
I only point this out as in investing, we only really learn if we are being truly honest with ourselves.

Traders selling, fatigued buyers from the old days selling. There will be short term selling pressure keeping a lid on things for a time.

But the PTAB is a massive buy flag. It was an astounding outcome for Nano. It offers a very futile road ahead for appeals and a grim day in court should it come to that. Any award will dwarf the current market cap by multiples.

As I’ve said, the full ramifications will be realised soon enough. And then this will really fly.

The market will catch up in time. Right now you are paying just an 8p premium for a stonking PTAB decision. Amazing entry point really when you think of it like that.

I think we will get some volatility over the next few days but ultimately will end up a lot higher once all the dust has settled. The market is valuing us at 130m give or take. A settlement alone, discounting any commercial production, could easily be 5 times that. It’s really important to bear in mind that the PTAB gives us the green light now to pursue the whole shady supply chain, not just samsung. I have no doubt that Mintz are sipping a glass of champagne on a job well done, but are very busy mapping their next moves too.
For my own part I will add when I can (will have to wait for payday now) and consider anything sub 50p a great value buy.
