The dispute cost more to prosecute through court than to settle with DHSC.

If the court is still adjourned, then both sides have lost a day.

But as time goes on, and out of court activity continues, then it's looking like an out of court settlement is more likely.

Should the court reserve judgment, the outcome will not be known perhaps for a while.

We don't know what that timescale might be.

Whatever the judgement - could it be that one side or the other, announce within that judgement, or the same time as the judgement, that they intend to appeal.

Should that happen, I don't see the sp reacting to that news with anything like the impetus a win

for one side or the other might achieve.

I don't know how likely that scenario is, but for me it's not impossible.
