H&N: no to what?
also PF did say "one of those" to the question of "5,10, 15 years??"...but i was hoping he was just being flippant and it may actually be longer.
No Aiming
Sorry .. no chance of getting anyone interested in law of contracts (or torts I believe below Hadrian's) .. second only to EU law ... and the curvature bananas, et al.
Jim i'll add "interested" to my list of multi meaning words...along with "imminent" "soon" etc
Hehe - ok Denning mentioned the case in another one in 1932!
At least I'm getting peeps interested in contract law!
Ha ha. Back to law school for you Jimzi.
MikeGP - don't forget - WSG use the word "pleased" when they do placing RNS also. Means different things to different people.
I doubt it, I know Denning was old but that was 1893 Court of Appeal.
Yep - put it in to shoiw off - can't remember at all what it was about - 35 years ago at law school!!
It was Denning though !
Payments on Account: it reads to me that they have adopted an applications process. WSG apply for the sum to which they believe that they are entitled - for works executed - the client agrees/disagrees to pay the application amount in full or in part, a sum is paid - whether the full application amount or part thereof and upon receipt of the payment WSG would raise the Sales/Tax invoice for the exact amount. Entered as a sale onto the books once the monies are received and the sales invoice has been raised, so any sales tax only becomes due/payable to the authorities at the point of receiving the payment. For works executed/services carried out where the application has not been raised or the application has not been fully agreed and the payment not yet received or sales invoice not raised, then it remain "work in progress" for which no sales tax would be payable.
You mean Carlil v Carbolic Small Ball Co. Jimzi, the precedent for the existence of a unilateral contract.
Apologies Vänder,... re-read your post,.... you are talking of not putting in a place a provisional/interim contract.
I would say that they have via a letter of appointment,... several times PF has said that we are appointed.

MPS are taking a very tough negotiating stance with scanport/ wsg
____
That is nonsense. Read the RNS.
"...and Westminster is pleased with the outcome. "
MPS are taking a very tough negotiating stance with scanport/ wsg. Couldn’t they offer a short term contract rather than a zero hours one? There is little good faith
The hybrid nature of the joint venture means that there is a convenient means for MPS to cut costs if required
Apologies: i was wrong you are right on this one H&N and Gibbo (and others). but doesn't the terminology refer to partial payment? i.e. they are making payments towards the amount owed towards clearing the account?
does that mean that we have been building up an account since we started and now they are starting to pay it off? or does it mean that they are making a smaller payment then is being accrued as MPS don't know the final fees so don't want to over pay. or does it mean that they are paying in arrears and so they are constantly going to be paying on account even if they're making the full payments that are owed.
i wonder if we'll ever know when we started getting paid - PF certainly implied/stated at the AGM that we were working for free to start with..but that was when it was expected to be wrapped up within a month.
Quite right Sunny.
And legal classes.
Major renovation work on house over a year- estimate X subject to alterations, difficulties etc.
Pay builder on account throughout the year - then final account when finished.
There is a contract - final amount to be determined.
You don't pay people on account if there is no contractual basis. And the payment is in accordance with some agreed term - of a contract - call it interim, pre-fully open or whatever, its a contract
Check out Carlye smokeball company case - the bedrock of the laws of contract.
AIMIng a payment on account is a cash payment. If they were just accruing revenue they would state they are accruing revenue.
This share is like myself and cannot maintain a rise. I strongly recommend Cialis in such instances.
Yikes!!!!!! I can't believe how many people here don't know what "paid/payment on account" means, it means the customer has paid and payment has been entered into the ledger, cor blimey guv. :-) we have received payment and are receiving payments, I'm going back to gardening.
The new information is that they are no longer doing work for free- which would have been extraordinary otherwise
The caveat is the expectation that the MPS negotiations will take months, and are much broader than fowler will have us believe
i disagree H&N: payment on account means that they are in effect accruing payment. if they were being paid in cash then it would say so. We are receiving revenue, but not cash. Basically no issue so long as a: the contract is signed and 2: they eventually pay over the cash
It sounds like the money maybe being held in escrow. Pending the agreement of the fees. If so, this doesn’t rule out another placing?
Stupid anyone selling at the moment, This share will rise up to contacts are signed
No..bank account. We are being paid for services rendered at the amount agreed.
It would be good if we get volumes scanned etc on regular updates in lieu o the silence and guessing up to contract award, as this is revenue it will be being booked so will come out eventually in accounts, do we get a q3 report? B
