Whilst I agree with a lot of your post 13:59 I do not think you are recognising the difficulties that NRW face with these determinations. For me this is all about the height of the bar they are going to set for the future. This is not just about the one mine, they know that they will have to apply the same criteria for probably a number of mines in the future.
NRW will be aware of the sensitivity of opening up these old workings and I believe before this is determined I wouldn't be surprised for this to either be reviewed by their own legal team, or advice sort from the Environment Agency legal teams some of who work at the cutting face of Environmental law.
Whilst I find the time being taken to provide the determinations frustrating, at the same time they may be setting a precedent for the future. This may actually help speed up the long term wider search and extraction of gold and other minerals across the whole gold belt. Time will tell but I am banking on a positive determination and for me they are just doing what they are paid for.
I anticipate that Included within NRWs quarterly achievement report, it may read '..............whilst protecting the following species in their natural habitat, working with a mining company in the Snowdonia National Park (I can remember its new Welsh name) we have helped facilitate the potential recovery and discovery of xxxxx tones of gold whilst xxxx number of skilled high paid jobs will be available for local people in the Dolgellau area.'
'The template developed for this determination will allow a pathway for speeding up all future applications with an expected NRW manpower hours saved of xxx over the next five years'
