BHP and NEM voted in favour as their contractual irrevocables stated. They can now wait for payment day or sell now post vote before delisting. And clearly the latter makes no sense. And you are claiming that they could turn around now and bid for Solgold … seriously. Sorry but this is just preposterous. The Court Hearing for the Sanction is Monday 2nd.

Do you know what custody services are? Do you know what a Prime Broker is? I have no idea who you are but you strike me as a lazy person who just makes things up as you go along. JP Morgan or Morgan Stanley or both could be offering Maxit custody services for example. And for many others. And also Prime brokers to many hedge funds.

You clearly never read filings nor understand the hedge fund relationships with investments banks which provide prime brokerage services. You probably don’t even know what this even means.

Markets price options and normally pay a premium for them. SOLG is not trading like it could receive a counter. If it was, one pays an optionality premium eg pay 1% through the terms at 28.28.

I think you all need to reconcile process pragmatism, what the Panel expects tied in with the Companies Act, Collaboration agreements and BoD fiduciary duties. There have been no counter bids between scheme succesful vote and sanctioning. Why is this? Legally you can argue what you want. Judges and the Panel will likely take a dim view on gatecrashing and a new bidder even if 2.7 will have conditions attached and due diligence required and not a given certainty.
