hard to say, its in the hands of the experts in court who will decide the similarities/differences. dispute would be over electrode materials, electrolyte and manufacturing techniques.
what cpx have been saying is that competitors have had trouble reaching cpx's reliability, power and energy density. ("most of cpx's competitors only manufacture higher capacity cylindrical cells used in large package modules and focus on applications where the combination of thinness, energy density and power density are not important considerations for the customer. These competitor products usually prove unsuitable for the various markets collectively labelled the IOT market, which is the key area cpx are targeting with former Murata products and their own existing prismatic products.")
i am getting the feeling that, in some cases possibly, once a licence is taken by a new licensee for cylinder shape caps, they have to improve their own product, eg. Cornell Dubilier's recent new range and maybe even TDKs. AVX sorted this in advance.
