thats what happened in the Caymens:
on or about April 15, 2019, Plaintiffs sought to withdraw their Cayman Action, including their appeal. On April 15, 2019, Outrider consented to the withdrawal (under certain conditions), and the Grand Court entered an order dismissing the Cayman Action and requiring payment of Outrider’s attorney’s fees.
but then:
Unbeknownst to Outrider, Frontera initiated the present action by filing its original complaint on April 14, 2019. Despite its regular dialogue with Outrider’s U.S. and Cayman lawyers, and its negotiations relating to withdrawal of the Cayman Action (which could not be done without Outrider consent), Frontera provided zero notice of this filing to Outrider. Frontera also failed to comply with Local Rule 3-13 upon filing this lawsuit, which requires notice to this Court of another proceeding involving “all or a material part of the same subject matter and/or substantially all of the same parties.”
