I don't think Choi will make it to court - I think he'll settle. However he'd have a strong argument in court in that it's incredibly hard to prove. He always said that was he was doing was not advice, plus he never lied even by implication. Plus, as a consumer you've got to be insane to follow these online "tips" and think you'll be ahead of the market. No one is posting their trades for entertainment value - no one.

In the absence of any information about this stock I thought I'd regale you with a wonderful SEC case I've just been reading in the US. A large short seller was pulled up by the SEC a couple months ago after having published their short position rationale along with the usual disclaimer that they are not our financial advisors and that they don't even know who we are and nothing in anything they publish is any kind of recommendation but merely an explanation of what they are doing. So the judge comes back and says all of this is fine but it's a little too cute - why did you tell people what you sold and when you sold it? Why don't you just trade in private? You're a company, you're profit motivated, where is the profit in publishing your trades?

To me this question from the SEC is absolutely magical he's come down on somewhere less than a fiduciary duty but certainly more than just entertainment purposes.

Can't possibly be. In any community of holders of a particular share in a company you would expect quite a strong bias towards the company. If somebody appears completely unbiased it would be a little strange but for somebody to be universally negative, they just can't possibly hold shares in the company.
