I've shifted another 30% today leaving 40% for any counter.

It meets the 5% threshold that BHP + Newmont can pull out but if we are saying that the retail/PI base is going to vote down 28p, are they suddenly going to accept 31p when a whopping 13% has shifted from no position to dead against?

It's just how I read it and we all do in different ways. The closer the market settles to the offer the greater the certainty it happens. If there was significant hope of a counter then we'd be 29-30p minimum right now. That may yet happen of course, I don't discount it and like you I hope it does.
