These material facts have not changed in several years - ANI, the JORC etc... Plus a few letters - And in the age of instant mail, also know as “EMAIL”, who actually uses the post? So in essence, all investors have is ‘hope’. That is not acceptable...

And as for Budge, I don’t doubt his competence, but he is paid to deliver, and he has failed to do so. Investors pay his salary, and for his follies such as Vadar and Fenoscandien. When they run out of funds - And they will, do you have the stomach for another fundraiser and dilution of your investment?

And there in a nutshell you have it... They have failed to adhere to there own legislation.

And as for blaming others ffs... As investors, we are truly blameless and have every right to be thoroughly annoyed. We have been misled. Wouldn’t you agree?

The RNS dated 25/4/13 stayed that the process would take 6-9 months. That was direct from the MI. 7-years later, amounts to an abuse of process in my humble opinion.

We know what’s in the ground... What has that got to do with illegal delays and interference in this process?

Kallak is why we are here... it’s why I stay. But the numbers to which you refer have not changed in several years. When was the last time we drilled? Perhaps Budge should have been using funds to finance more exploration, increasing the JORC and then making our case (even more) irresistible.

Aug, it’s clear that our ‘wait and see’ policy wasn't worked. Our investment devalues year after year, and we still do not have our exploitation licence. What markers for progress do we have? I would have thought that the share price was most telling. 136m shares in issue when I first invested... there is now 602m. Digest that for a moment...

So again I ask the question. How has ‘wait and see’ worked so far?

I want this to succeed as much as anyone... but is it really too much to ask to expect some positive action. All the posts about stuff happening behind the seconds is nonsense. All we get are pictures of Budge and the local mayor. He might as well meet up with the local Butcher or candlestick maker...

Aug... in no particular order:

1. How could this matter possibly end up in court, were ‘legal action’ not to be taken? I’m advocating that BEM drives this process. Your post is somewhat contradictory on that point. There has been a clear abuse of process. How else would you describe an application that should take “6-9 months” that has taken nearly 7-years. (note the quotation marks - It’s taken from the RNS 25/4/13)

2. Brokers that arrange the placings with investors spin or sell the shares on their clients behalf within the permitted timeframes. They do this for profit. They do not retain the shares. We don’t have institutional investors. Placings simply raise cash. It’s used for salaries etc. and operational costs (Necessary for a company like BEM) And recently for investments in Kosovo and Finland. Neither of which I ageee with. They are not investing in BEM.

So basically you advocate ‘wait and see’? It’s not exactly stood us in good stead so far has it? As a long term investor, our investment is worth less year on year. That is a fact.

Which is precisely why Budge should be raising funds for legal action and not private investments in vanity projects. The brokers that he uses to raise funds care not a jot what the cash raised is used for, they simply spin the shares on the open market for profit. And please, spare me the ‘you could sell’ and ‘it’s your choice to remain invested’ spiel. This has become a complete disaster for many on here... Legal action was described as the nuclear option... well here we are. Get it done Budge, because there is no other way. Sirius minerals scenario anyone? Because that is where we are heading...
