WHY ARE MAXWELL LAWYERS USING THE ALICE TEST AS THEIR DEFENCE?

Why are Maxwell Lawyers using this as their defence?

Here's a scenario.

They do the Alice test.

Judge states I can't make a decision until I know if Tesla have the right to rescind their free patents.

Case suspended until the Tesla v Cap-xx trial.

??

Tesla are suing Cap-xx.

The Alice test is an inspection of the patent and its validity to be granted.

During the Loxus trial this validity would not involve Tesla because Tesla at that point couldn't care less....test passed.

Now Tesla do care and they are saying Cap-xx have infringed their patents prior.

They could be using this to change the Alice test outcome.

Nothing to do with loxus.

What I am saying is now Tesla have been added to the equation.

They are suing Cap-xx for patent infringement.

Are they bringing that tactic forward and using it here to invalidate Cap-xx patents here.

If its JUST about money, why are Maxwells lawyers trying to invalidate Cap-xx patents?

I am sure Maxwells lawyers are not stupid.

Is this an attempt to invalidate Cap-xx patents because they are based around Teslas patents?

Previous cases with the Alice test would not have had this situation in the equation because Tesla was not bothered about them.

What happens to Cap-xx if they succeed?

Yes it might be the same patent.

But they are different products.

Not all supercaps are manufactured the same.

Cap- xx previous infringement cases will be valuable experience.

They will be well aware of what is required to defend their ip...

They will be well aware of what failure would mean to the company and investors.

My money says they know what they are taking on and are confident.

But there's always a BUT!

If Cap-xx lose....what then?

Next week will decide current holders cap-xx investing future.

I'm prepared for either a positive or negative result.

Seems some on here think it's only going to be positive.

Been trying to figure out the last 4 years patent infringement history. Been following it with one eye but not 100% satisfied with my assumptions.

EM/Tesla bought Maxwell for the dry cell electrode patents....these are not the patents being fought over?

I have read on here the patents going through litergation are out outdated and it's only backdated sales Capx are pursuing?

Yet the offending articles stated by Capx are still being sold.

So what is all this about?

I expect it to go to trial now...unless Capx have something EM...wants.

Like a future electrode tech.

It's a cancellation and correction from a trade on Friday.
