Redon, while it's probably wise not to raise expectations too high, what you write makes good sense.

Frankly, if the ECT was designed to prevent governments cheating companies out of legitimate revenue (which is what appears to have happened here), then the RKH award ought to be as you suggest and for the likes of greenspot, certainly NOT a "side show".

Thanks for the earlier posts about the OM claim and the enforcement of any award.
Anyone who's obtained some sort of award will know how enforcing enforcement can get lengthy and expensive (especially where the defendant has decided they don't want to pay).

I realise that in theory RKH would be able to enforce by seizing Italian assets in the UK, which is no doubt quite possible (although, how many readers of this have actually done it?), but in my experience, if you've won a claim against a known awkward person/company who doesn't want to settle, enforcement can be a frustrating process.

Which leads to the real issue here, which is that as RKH cash runs down (even if gradually) and FID and then sanction are postponed for perhaps perfectly acceptable reasons, there must come a nail-biting point at which RKH BoD may have to find the least destructive option for raising more money.

What we really need is a good spreadsheet with all the identified assets and liabilities, so that the various "what ifs" discussed here, can be tested to provide the worst case and best case scenarios.
That would focus attention on trying to improve all the "guesstimates" discussed here and on the date by which SL FID HAS to be announced without causing problems.

A lot of numbers flying around, but how many will prove to be right, starting with the possible ECT award?
On that one the predicted number ranges from zero (no award), to €275 (Mogger's article) and in between, a whole range of possibilities including the award being reduced by 50%, the Italians not paying necessitating RKH having to sell it at a discount, etc., etc.

From my perspective, until we a have a better idea of the numbers, I think I'd prefer a more general assessment of the certain, likely and speculative assets and liabilities perhaps with indicative timings.

I think this is the first time we've seen an actual number and also the suggestion that if RKH is having trouble recovering the award (assuming one's given) they might consider selling it on for a reduced sum, which I know is an option, but I don't recall anyone mentioning it.
