Sadly perhaps, sain, it won't turn a weak case better but I suspect that it is in both side's interests to cobble something together, rather than drag through the courts. Whoever wins in High Court , the loser would appeal all the way up. That will take years and make the lawyers shed loads more dosh. Would also serve to devalue commercial property even more and as you have already pointed out, that is not in either side's best interests. So I think both sides should come to their business sense quickly and make a 'Commercial' Compromise.
