Nanonano, just so we are clear he said a win in court could be worth multiples of the value of the company and that a settlement would be a fair reflection of lost revenue from IP licence. Only the latter part is open to criticism. There is then the discount a negotiated settlement inevitably comes with. Some think that the outcome was fair, others think it wasn't. I can honestly say I hoped for more but understood given the calibre of people involved making the decisions that the settlement was likely just. BT did not rail against the backers, the legal team or the advisors and acted alone and we don't know all of the intricacies of the case, what Samsung's defence was, what weaknesses we had then there was the risk of needing more money to remain a going concern. I don't think it's fair to lay all of this at BT's feet. The goings on with calls etc will never be fully known either. I do believe that the professional II's will have mapped out the implications of settlement scenarios and that includes immediate recognition of what the low case meant. The fact we didn't is our fault not theirs. We see risk differently to them. FWIW I don't include TH as a professional II.
