I assume you mean you're here because you wanted advice on deciding to invest here. However from the 6 point scenario you posted previously the only point worth investing on is point 6, which you have excluded. In your words:

The only possible way you could invest is if point 6 plays out, and yet you are saying people are gullible for believing in that scenario (the correct scenario in my opinion). You'll be too late to invest by then anyway.

The realistic time line is in 3 weeks. The case has already been going on for 4 years and the decisive trial starts on 11th December.
$40m settlement will send it far higher than 2p.

Newuncle, I don't think it's even about the value of the sales. It's the principle of defending their IP - the value of royalties from CDE and Ioxus was relatively small, but CAP-XX refused to allow their patents to be used illegally.
Sushi I agree with most of what you say apart from future royalties. Future royalties are not in scope because the patents have already expired.

It's document number 123, exhibit 116 on the docket, dated May 10th 2022. The figures are all redacted but it has the following:

Maxwell are arguing for point 3, CAP-XX for point 1.
That's correct Abbey, the recent documents will have calculations of damages - previously (when they were only discussing damages within the USA) these were released to the docket but were heavily redacted, however they did contain some insight.
The case is for past royalties only. The parents concerned expired several years ago.
There is no RNS because this is going to trial in a few weeks. They are already discussing jury selection.

Judge Jennifer Hall has already been referred to a couple of times in the trial for discovery and ADR, so nothing unusual.

Obviously would love to see a settlement tonight, but I can't see anything other than the full jury trial, which in my opinion will be settling the scope of damages rather than a win / no win. Maxwell are hoping to persuade the jury that CAP-XX are only eligible for sales within the US, whereas CAP-XX are arguing for worldwide.
The trial is scheduled for 5 days between 11th-15th December, so we should know the result on the evening of the 15th December:
