except of course we know that BioNTech have a commercial option on the Modi 1 epitopes for use in TCR. And it is reasonable to assume that any deal would be conditional on the granting of the US patent for those specific epitopes. And that if an agreement was made conditional on the patent, then we may realistically expect a degree of radio silence from the company whilst that deal was complete. Oh and we also know the US patent is to be granted next Tuesday..

A slight correction on the Japanese one.. i think that is still being examined.

The US Patent Notification has been issued. This means the application has now been assigned an actual patent number and the intended grant date has been set. According to the Patent Term Adjustment, it looks like patent will be issued on the 19th March.

Could be an interesting date if any commercial deals were dependent on that patent.

i would not be surprised if it took longer than average, due to the backlog from the shutdown. But that is pure assumption and speculation on my part. I don't know for definite either way.

Those are the dates that the notification of grant was sent - the US was notification of being "ready for issue" was 25th Jan.

There is a subsequent administrative task to actually prepare and actually issue the patent. the use patent was sent to the FDC (Final Data Capture) on the 5th Feb. From there it is typically 3-5 weeks for the patent number to be issued and a sealed copy sent to the Office of Patent Publication.

...dont forget Australia and South Africa (which were approved quickly).

Japan notification of grant was dated 29/1/19
Chinese was 27/12/18 (but i only just checked yesterday)

Worth noting that both the Chinese and Japanese patent applications have now been formally accepted for grant too.

The patent will add little in terms of SP but will add billions in terms of value.

The examiner approved the US patent in principle, but asked for a post approval minor change to a table in the application before he would issue.

Scancell submitted that change, just before the US government shutdown, and whilst the USPTO acknowledged receipt, there was no further processing. On the day the US government reopened, they posted an update to our lawyers to say they are now happy with the amend, and that the application is now deemed ready to issue.

In other words, dragged on a bit these last couple of months, but US patent is confirmed accepted.
