Late last year, we noticed from the public record, and subsequently through an RNS that the European Moditope Patent had been "Intended for Grant".
However, what Scancell didn't RNS was the fact that they subsequently appear to have contested the wording of the granted text, and wanted re-reinstatement of some text that had been removed by the examiner. This resulted in another seven month round of negotiations with the examiner, which has finally concluded, with a second notification of intention to grant.
Its worth noting that in contesting the text, Scancell retained the right to "fall back" onto the previously granted application.
As to why Scancell decided to go back and amend their own application, I cannot say. Were 3rd parties involved? This was all done after the agreement with Biontech was in place.
Anyway, for those that though the formal granting of the application may have been catalyst for commercial action, then that granting is seemingly now going ahead.
