As far as I'm aware KM was not planning any legal challenge other than to sit it out for Ganfeng to take the issue on, something changed that and I'm thinking it was the Chinese Mexican trade agreement being explicit on the nationalisation of the investments and other terms. This may have prompted KDNC to search for a similar agreement and of course that exists and is the basis for the KDNC challenge.
I do believe there's a great degree of confidence in the outcome favouring both Ganfeng and KDNC, the trade agreements are similar in wording.

Vocal Accusations and Arrest Jalife’s vocal accusations against Clouthier have been far from subtle.
He claimed that she stole Mexico’s lithium and surrendered the Mexican state to the Americans.
A claim that Clouthier has vehemently refuted on her social media platforms. The allegations, however, are not considered serious crimes by the Mexican Judiciary, and thus do not warrant pre-trial detention. Jalife’s legal fate now lies in the hands of the Control Judge.

In this sense, there are indications that the information requested by citizens from the Ministry of Economy exists. In addition, this institution has administrative units that could have what was requested and that were not consulted in the search process. To me it seems A_L.O and co are seeing how far they can stretch the Chinese gov, IMHO the stunt in San Francisco was to see how far he could test the patience of the Chinese by inviting XI to see the Sonora Plan and to gauge the Chinese reaction.
Judging by the press coverage after San Francisco on the Ganfeng situation asking specifically if they were discussed with President XI leads me to believe there’s a great deal of doubt with what the gov are doing.

I'm sure they were 90% there with their extraction process several months ago according to LMAO.
It also been made clear by Peter Secker and Ganfeng that they believe they have kept up with investments and given the the multiple reasons why the concessions were being reviewed I doubt they would have legally been required to continue to invest under those circumstances.
Ironic that Durazo would take the opportunity to announce extraction from clays is a possibility, has he forgot the hand held tour of the pilot plant where - yes!! lithium extraction from clays has been ongoing for several years.
Seems the rhetoric is softening, no mention of the nationalisation or concessions being revoked.

There is technology to separate clay from lithium discovered in the Sierra de Sonora area, reported Alfonso Durazo Montaño .
The governor of Sonora declared that there is a dispute over the mineral, because the Chinese mining company filed an injunction.
He explained that despite this, Litio Mx works to advance technology to separate lithium from clay.
