It appears that the Maxwell defence is that these Patents invalid as they think this is a natural phenomena free for all, they having access to them as CPX products which are just one of natural laws or abstract and should never have been patented. so they do not recognise the patent and or see these patents as invalid.
Section 101 defines patent-eligible subject matter as "any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof." In Alice, however, the justices ruled that laws of nature, natural phenomena or abstract ideas cannot be patented.
So this is their defence. As soon as the judge dismisses this defence, Maxwell may immediately attempt to settle. This should be over quickly. Once patents are recognised Maxwell`s defence is gone. Then it is down to the Jury to issue an amount for damages.
Looking good for CPX. These shares are beauties that will shoot up on win.
