Having read the document, whilst Ocado are majoring on Autostores ommissions in their applications for US patents, that does appear to be a first step. If succesfully proved, it will cost Autostore $millions in fines and damages. The second stage would ne then to come to then prove that Autostores technology is in breach. Ommissions of evidence do not in themselves prove that Autostores devices are illegally copied and likewise do not disprove that Ocado was itself in breach of copyright law. This is a holding exercise aimed at delaying Autostores from pursuing their claim against Ocado but if fraud is proven, it would leave a much tarnished smell once the original claim is recommenced. Lets be fair to Autostores though, their technology has been sold some 10 times more than the small fish newcomer Ocado.
