Justice denies payment of insurance to Anglo American and Zamin
Companies try to receive insurance, today at R $ 1 billion, in the case of the collapse of the Port of Santana.
The Rio de Janeiro Court of Justice unanimously upheld a first degree decision that denied the payment of compensation to the mining companies Anglo American and Zamin, in the case of the collapse of the Port of Santana, killing six workers. Since March 2013, when the accident occurred, companies have tried to receive insurance, today at R $ 1 billion.
The court ruling found that Anglo American lacked caution in ore storage at the port. The reports concluded that the overload of the soil, caused by the stock above the safe limit, and the traffic of heavy vehicles led to the collapse of the port. The company would have increased the handling of shipped ore by 11 times, without taking safety measures to ensure the stability of the terrain.
Anglo American said the accident was due to natural and unpredictable causes. He claimed that there was a sudden mass movement associated with the clayey and sensitive soil in the port area. However, this defense was not sufficient in the trial of the case two years ago in the first instance and again rejected by the judges of Rio de Janeiro.
Seven months after the accident, Anglo sold its operations to Zamin Mineração. The port was not recovered and the export of ore was limited. With little movement, Zamin decided to abandon the facilities in Santana and left debts with workers and supplier companies.
Complaint
In April of this year, Anglo and 4 other people (general director, legal director, general manager and a coordinator) were denounced by the State Public Ministry for the death of workers, in addition to environmental crimes. All the ore and heavy machinery that were in the port were dragged to the Amazon River.
