The ICSID are alive and well. You can see this from other cases. Obviously I didn't check them all, but did look at quite a number and all of those I did had been updated more recently than 'ours'. Most by some margin. Perhaps the files have got stuck in someone's drawer, ho, ho, ho.

That's the eye catching bit and the devil is always in the detail, "the award" stated twice. The other thing I saw was the fact they have (finally) moved back to Salisbury, "In addition, the Company announces that it is changing its registered office address to Warner House, 123 Castle Street, Salisbury, SP1 3UA, effective immediately." Perhaps London's fancy restaurants being closed down for a while had something to do with it. ;-)

@Ovets Many thanks for the extra information. It helped me spot the limitations of the appeal process after further reading. I presume Mr. Moody would not be at liberty to say when he believes a ruling will be made even should he know. In-between the Hob Nobs, he is bound to have been on the blower to both King & Spalding and Harbour.
Anyway Ovets, hopefully your analysis will prove correct.

Although not uncommon for cases launched at the same time to still be pending, I couldn't find any other case that had seen inaction for such a long period. The ICSID is working - this is plain to see if you look at other cases.
The other thing that caught my eye is, even if there is an award, it would appear that under certain conditions it can be appealed.
"I asked about OM timeline in or around March and received a prompt reply from SM. Arb results were expected as per last RNS but BoD have no control on timing."
Interesting. According to ICSID rule 46:
"The award (including any individual or dissenting opinion) shall be drawn up and signed within 120 days after closure of the proceeding. The Tribunal may, however, extend this period by a further 60 days if it would otherwise be unable to draw up the award."

Says post-hearing briefs were held on the 30 October 19. One hundred and twenty days took us to the end of February. Allow for the extension of sixty daysm then that would have been the end of April. Even with Covid, the ICSID has been up and running. How far off can it really be?

Ask the straight question, "How close to OM arbitration results were we on the lead up to lock down?"
As to the board are solely interested int keeping this ship afloat to soak up their salary. Quite possibly, however, I would suggest they would also be interested in keeping this going for that very reason. It is not as if it is very taxing.
@Godders99 You would be better contacting RKH directly. How about asking them how close to an OM judgement were we before 'the plague' struck? It would be a *constructive* start.
@barnyards I seem to remember that you sold quite a number at about 10 pence at the beginning of June, but left a few in for the possibility of an OM payout. Is this still the case? Can I presume, that *if* OM payout does come to something that would be you fully out again?
Speak of the OM judgement. Given that this covid hoo-ha has been going on for x number of months there would presumably be some logic in the delay being no more than this period. Put simply, we were supposedly on the cusp of an announcement, so should still be on the cusp of an announcement.
It is somewhat reassuring that you have received a polite, and what looks to be honest response. There are quite a number of ifs, although nothing that we do not know about. If those ducks line up, we should see some kind of reasonable reward from this long, long journey.
It has the same feel as, when playing Monopoly, you're forced to mortgaging your remaining properties just to pay rent.
