From the prelims in June:

“D2W and FDA approval for bread packaging and other applications

We now have commercial visibility for our FDA approved technology together with other applications in at least eight territories where we shortly expect completion of commercial trials.”

Not stalled in my opinion. Whilst not yet significantly contributing to revenues pending completion of the commercial trials it is clear that significant progress is being made.

….. that SYM raised £2.25 million at 20p a share as recently as June this year, no doubt after significant due diligence regarding the company’s prospects and the benefit of more information than your average private investor is likely to have.

Not wishful thinking at all. We don’t sell plastic products. We sell the additive D2W which manufacturers can, if they choose, include in the plastic products they produce. It is the sale of the products in Europe that may or may not be caught by the directive. So it is the manufacturer and seller of the products that would, or might be, challenged, not Symphony as they are simply providing the additive. That’s why the producer would bear the major (or all) costs of a challenge to the sale of its products by someone seeking to establish that the product was being sold in breach of the directive.

Interesting that you think I might not be holding and yet be a ramper. Not sure what the point of that would be.

The “market” usually consists on any given day of a few private investors or traders who can indeed be influenced by what is said on a chat board like this.

I am sure you already know this. It’s unlikely that you are as naive as you pretend to be. On the other hand , if you really think an RNS might go unnoticed by the market, well perhaps you are!

There is no ambiguity in the RNS beyond the inherent ambiguity of the situation itself. I have done my best to explain my understanding of the impact of the RNS (not much as far as current trading is concerned) and how the situation may be resolved in the future. There is absolutely no reason whatsoever for this to “derail” India, and one wonders why you would suggest it might. For someone who says they are invested and would rather see the SP rise, you are doing a very good job of talking the share down.

With all due respect Shatter, you say you are a LTH and yet by your own account have been selling and wish you had sold more! Do you really hope the sp doesn’t “tank” or would you in fact welcome that so you can buy more back cheaper?

Personally, I am hoping that, having got the Irish EPA news out of the way, we will now get an upbeat RNS with the interims, which are certainly due. Obviously, we know already that H1 was disappointing, but we are almost at the end of Q3 and it could well be that they will be able to report much better trading so far in Q3, as well as prospects going forward. GL all holders.

We will just have to wait and see. Personally, I think it was a smart move to put this RNS out on a Friday after close of play. This, hopefully, will have prevented some knee jerk selling. There may still be some, but hopefully LTH’s will hang on because 1) this EPA climb down will have zero impact on current trading; 2) we may yet get some contracts in the EU if some companies are prepared to use D2W on the back of the opinion; and 3) favourable news could drop literally any day on any number of other aspects of SYM’s non EU focussed business.

Secondly, wait until anyone challenges a producer selling products including D2W and support the producer in its defence. Based on the KC’s opinion there must be a good chance of such a defence succeeding and the major cost would be borne by the challenged producer, rather than SYM. The question is will there be manufacturers brave enough to forge ahead, backed by the opinion, and risk having to defend a challenge? Maybe, I don’t know.

I don’t advocate this though as it would be an unnecessary diversion and expense at this juncture. Better to focus on non EU markets and those producers within the EU who may be prepared to risk being challenged and defending their stance as per the KC’s position.

There are two ways this could happen in my opinion.

First, SYM could seek a court declaration that products manufactured with D2W are not caught by the Directive. This is what they should have done before, instead of trying to get the Directive declared illegal to the extent that it purportedly applied to such products. This was doomed to fail in my opinion because the EU could simply say that it made it’s decision correctly, legally, at the time, and a lot of the scientific evidence produced subsequently was therefore irrelevant.

The problem for SYM, notwithstanding the KC opinion, is that any producers of products with D2W will have to have the confidence that, if challenged, they can defend the marketing of their products on the basis that they are not caught by the Directive, as per the opinion. Some might have the balls to do that, others might not, so, sadly uncertainty is likely to remain in the EU until the position is resolved one way or the other.

I think it is almost certain that the EPA were got at, perhaps by the EU itself (telling them off for allegedly stepping outside of their remit) or by some competitor industry body (e.g. the “compostable” plastic industry). There is no logical reason for their climb down otherwise. It is pretty clear, in my opinion, that they, the EPA, were in favour of the use of D2W in Ireland as they saw the potential advantages for the environment there, but they have been browbeaten into effectively adopting a “it’s not up to us” position.

Good interview and great to hear that the bearings issue on the existing compressor should be resolved in about a week, and the new compressor up and running about a week after that.

In the prelims both the Chairman and the CEO stated that completion of certification was targeted for Q3 2025. It is true that earlier in his review the CEO referred to certification being completed “during 2025” but later in the same statement he clarifies this as Q3. Historically, unlike some other shares, I do not recall this being a leaky ship so I don’t see recent share price performance being anything other than a few PIs getting twitchy and selling in a thin market. Personally, given we are talking India, I am not placing bets on it being done on time but you never know. In any event, thankfully, this is far from being the only iron in SYM’s fire. News could literally drop on any number of things any day.

…..not to mention the Irish judgement opening up the European market!

1) We have recently raised 2.25m at a big premium;

2) We are most likely in profit by now, having been close to breaking even in Q1;

3) several trials were due to complete in H1.

4) Indian certification was anticipated by the end of this month with sales commencing before the year end.

5) the highly profitable new Nbr product has been launched and sales will be ramping up.

6) The D2P anti microbial food packaging product was being expanded into at least another 8 countries.

These are just some of the reasons to be optimistic in my view. Probably not long to wait for the interims and a general update. GLA and DYOR etc.
