Spikeyj there are small amounts due from two investors (£1000 each). Would this suffice for the holdup?
By "the KMK penalty clause" do you mean the following?: "In addition, Amphion will be issuing the Lender 663,627 3-year simulated warrants at an exercise price of 56.25 pence per share. If the Lender exercises the warrants, Amphion will pay the difference between the exercise price and the Kromek market price. The Company will also pay a further 8 per cent of the gross amount provided as an implementation fee." I understand this is good for AMP since "Amphion will pay the difference" upon exercising the warrant . But what is a simulated warrant?

hottrader, as i mentioned previously Datatern is very far from wining any case it will take years as opposed to weeks to get any result and as for favorable, who knows. Choosing to fight a giant with a small club could cost dearly.
Hottrader, Its not case closed yet... For microstrategy: "U.S. District Court in Massachusetts (the "Court"), which denied two motions for summary judgment filed by MicroStrategy Inc. ("MicroStrategy") seeking dismissal of DataTern's claims on the grounds of validity and infringement. " - could get further motions from microstrategy. Close to wining this case IMO but not quite there and no timeframe for when a settlement will be reached. For Microsoft: "in April 2014, DataTern received a ruling from the FCCA of the appeal filed in relation to the Microsoft declaratory judgment motion heard earlier in New York, which its legal advisers considered favourable. In July 2014, the ruling received in April became final. As a result, the case in New York was terminated, with the result that the previously unfavourable Markman ruling of August 2012 was, in the case of Microsoft, nullified." - a nullified ruling favours Amphion but again, there could be further motions/appeals etc. Cases are expected to move ahead in the next 6 months (i.e. before March 2016) "the Company's Board expects to have a Markman hearing in Texas in 2016". This is microsoft we are dealing with here and I'm sure they have a massively strong legal department to deal with this case. Again we have not won this case yet - long way off.
As ClockWork has stated, we don't know the details of whether RT may/may_not have had the opportunity to take part in placing. But as it happens, this will soon be to our advantage...

Clock.. "The placing did not proceed at that stage"... might imply the placing was abandoned before 30 September to make way for this FUNDING PACKAGE. Today's RNS clearly states "placing that the Company is currently finalising".. There will be a placing... but there will most likely be more i.e. DAN will purchase an asset with additional funds.. possibly increase potential to profit/expand business etc.
Thanks for clarifying spikeyj. So DAN stated "The Company is making progress on the funding package" and 13 trading days later, we still know NOTHING. Oh but wait, they have now confirmed their intention was to undertake a PLACING in conjunction with the release of its annual accounts for the year ended 31 March 2015.... They are definitely using the terms PLACING and FUNDING PACKAGE separately implying that there is more news to come. Time will tell.
1,666,666 shares, is that all they wanted out of the placing? Surely you don't have to be a "die hard" to look at this quantity and laugh... RT has the capacity to buy 36M shares.. Could there be another "funding package" due for announcement? Why didn't DAN make it clear from the beginning if all they wanted was a placing?? Lots of questions but my eye is on RT.. You're right no quick sale and RT will buy back up to 9.9. I expect a sharp rise even when he gets his first tranche purely from the potential for him to follow his intentions. Aka catalyst The success of Dan is underpinned by quob. If RT expects profitability in 2016 it's pretty much done. Business is expanding and I expect 4p before mid 2015 latest.
Jub you must be one of very few who thinks RT topping up past 6.1% will not raise sp substantially (free float might have something to do with it). Even spikeyj is on side with this one. Tell you what I will open the RT CATALYST thread in your name too!
Bullish reasons: 1) epsilon topped up with a sizeable chunk (value wise with respect to their existing holding) 2) RT could provide a catalyst for a sharp rise 3) Dan to return to profit this year - according to RT who has been very honest about his actions up until now (although it can be argued that he is selling a portion of his stake) 4) office space expansion suggesting business office is growing These are all bullish - it's just that you choose to ignore all spikeyj.

"asset" or "investment"... call it what you want... what kind of asset/investment would be appreciated by DAN and RT at the same time... what kind of asset/investment would be valued by both parties at 3.35p per share? DAN is a brokerage whilst Quob is an investment firm.... how can a single asset by valuable to both??? I was previously puzzled by this question and still am. The only asset that can be valued by both equally is cash... 3.35p for DAN shares... but why would anyone pay above market value? leads me to my next question, why did Epsilon pay 3.35p in last placing when DAN was clearly valued much less by the market.
Any idea what RTs asset is? The one he is supposedly acquiring for exchange with Dan shares?

Bottom line is, we have no details about the contract between RT and 3.35p buyer.... I am just stating that RT still has "an interest" in 9.99% even after selling down to 6.1%. I have also stated why Quob has mentioned £900k at 3.35p to counter your silly comment about 33.5p.... Balance is good on this board but no one wants to hear silly comments. Thanks for your response.

Pointless comment. 'it's worth £9million based on 33.5p.' Except he is selling at 3.35p so it is worth £900k to RT as he stated. "this is the guy who said he was buying more qpp shares, when he was actually dumping his shares " circumstances changed at QPP i believe his intention was to buy shares with cash received from collateral but he was forced out. Although RT is effectively selling shares, he has the intention of buying back up to 9.99% holding and this should provide a catalyst for sp reaching short term target. In addition, he has provided warrants to the buyer that will guarantee no loss for up to 3 years ("investment underwritten for up to 3 years")... shows how much RT believes in his valuation. So although RT will sell, he still has an interest in seeing SP of 3.35p+ for those shares he sells.
