That is a very well thought through post. The intended ventures to IOW and Dunsfold were the sign that all was not as it seemed. It was more a case of finding another target to replace the flop of HH and keeping the punters optimistic of a brave new world.
None of that is to say SCC have been shocking in their so-called democracy. If I had to guess I would think they will want to try re-run the meeting. It would be unheard of but then they could argue exceptional circumstances of IT kit not working. The only problem with that idea is the other applications heard afterwards which might have been non controversial.

You are confusing the professional planning officers with the elected councillors. It was the latter who voted against advice.
Don’t read anything into the decision notice not being completed yet. This can take a week or two. I have just watched the last part of the meeting. I think there are strong grounds for an appeal on procedural grounds alone ie
1 they clearly took the decision 6-5 to refuse on grounds which had not been established. The fact that they then cooked up reasons and had another vote on reasons is neither here nor there
2 one councillor was incapable of using his laptop microphone so it is doubtful whether he got the drift of what was going on
3 one councillor had another family member helping him vote. He might be hard of hearing but it does suggest he might not have picked up the debate.

I think there has been a denial of natural justice and am writing to the monitoring officer to add my concerns.

Sorry to be boring but it will be anything up to a year before any appeal will be decided. There is already a three month backlog at the Inspectorate due to the virus and it can take 6 months anyway in normal circumstances. UKOG can only appeal when they have the decision notice which gives the reasons for refusal and then their agents will put together the papers to be submitted. This could take several weeks.
Unfortunately UKOG will only get back its costs for the appeal and cannot claim any other costs eg for the application in the first place or business losses.

Local action trumps logic in planning which is one reason why government should look at stripping councils of some planning functions.

The law as I remember it is that it is illegal to issue shares below the nominal value and you have to go through a court procedure/scheme of arrangement type action to do anything. It's a company law not an AIM matter. I can see the option of some sort of consolidation in there too.

The costs of the inevitably successful appeal will have to be a hit on Surrey but remember UKOG has to cough up the funds to appeal in the first place. Money is tight and these things don't take five minutes and time is precious when you have no money.

1) Hardly any oil and precious little prospect of any oil or gas
2) Hardly any money in the kitty
3) SS says equity fundraising is on the cards
This isn't an investable business, it is a trader's share

How long the appeal will take?
Once the decision notice is issued by SCC, UKOG can then appeal because they then know the grounds for refusal. The inspector will normally consider it within a few months. However appeals have been hopelessly delayed because of Covid-19 as inspectors cannot visit sites.
I would think SS already has a suitably qualified firm lined up ready to go so as not to waste time. Natural justice has not been served here and I wonder if there will be other consequences for their performance apart from just costs of the appeal. Sadly councillors cannot be hit in their pocket. That would certainly focus minds better.

The grounds for appeal will become apparent when the decision notice is issued in the next few days. UKOG have been shabbily treated here and there is no doubt in my mind that they will win on appeal and get their costs of the appeal.
I am involved in lots of meetings and the way this meeting was held, the incompetance of the IT and councillors inability to use their ipads all added to utter confusion. I absolve the chairman from this- he must be tearing his hair out. SCC should be ashamed of themselves in allowing this shambles which does no service to their reputation.

Northfork I doubt you could call these councillors champagne socialists as all but 3 are Tories! They are pandering to the objectors in their areas. Elections next May after all.

You try being a professional planning officer dealing with these types of issues and the councillor questions. I think in the circumstances he is doing a good job.

You make a very interesting point. The govt is coming out with a new "plan" which will only allow councillors to deal with policies not plans in detail. Something called zoning. You might agree.

Decision when they vote immediately after the debate.
It will be lunchtime shortly and they will all be acutely aware they need to finish up!

Actually the process is there is a debate by councillors and they vote at the end of the debate. That's live on the council's website "webcast" so those who are watching know the decision immediately.

That's a long sentence which is hard to fathom without punctuation but the gist appears to be that we could be back to 11p. No way. We have at least double the number of shares in issue since those heady days and the prospect of UKOG being worth £8bn market cap is pure fantasy, much as many would like it to be right. We need to get the black stuff out of the ground to make significant progress.

Just to be clear the Surrey Planning and Regulatory committee meeting starts at 10.30am. The Dunsfold application is item 7 after questions from councillors and the public among other things. It will be live streamed. It isn't a confirmation in the strictest sense of the word as there is no approval yet. That's what the committee is doing on Monday.
