Arbitration didn’t fall apart. Both sides went to arbitration, which neither side had to do. The dispute could have gone to court . However most legal systems around the world follow ELS. After

So it wasn’t a failure but a process that needed to be done and at this disclosure stage the weight of the argument is with GST Choo & Mervyn failed in their obligation to abide by the Arbitration as they accepted this process by going to Arbitration.
