Although as I hinted at before when responding to FrankM, I'm not sure MED3000 is directly comparable to something like Minoxidil. With MED3000 (placebo derived) there doesn't appear to be an active compound. All the other Dermasys 'formulations' relied on an active compound such as GTN. MED3000 is theorized to work in some physiological way (heating & cooling cycle). This may be patentable also but probably in a different way to the previous 'formulations'.

Even if MED3000 doesn't attain a patent there is nothing to prevent it being sold OTC (assuming regulatory approval is granted)...just that Futura's IP is less strong. Patents & regulatory approval are different things.

Jet, I'm not on personal speaking terms with Mr Barder. In the past I have emailed Futura and he has personally responded the very same day. Those days are gone...they now rely on a PR company to shield themselves (for whatever reasons). I did tell you all that I emailed Futura about Dermasys being patented (the wording has now apparently changed!!) but got a blanket response from the PR company, something about market sensitive information...I am sure others will fill in the details.

FrankMu, you could well be right. You obviously have more experience about patents than any of us (albeit more hardware focussed).

I would just say that the description of Dermasys & all previously patented formulations involved in delivering an active compound (or molecule) through the skin barrier. As far as I'm aware with MED3000 they haven't specified an active compound, the mode of action seems to be different. I'm not sure if this will impact on the type of patent they have applied for.....something to bear in mind perhaps.
They have undertaken research on the mode of action btw....so presumably Futura do want to know how MED3000 actually works. But that might not be for the patent application of course but more for the upcoming negotiations with potential partners.

theItalian, clearly you've thought about this and I reckon your open-minded approach is sensible...the fact that you disagree with me is fine. I openly admit that I don't know enough about the patent process...I'm just trying to ask sensible questions. People like you can make up your own mind whether to investigate further.
Your approach is quite refreshing compared to some of the numbskulls on here who dismiss any comment that disagrees with their cosy view of the world. Personally I like to try to keep an open mind (never easy when one has a vested interest in a company).

Personally I'm not too sure whether potential commercial partners will be that interested in whether MED3000 has a patent, possibly they will just care about whether there is a market. But FUM are making claims about the IP of Dermasys & MED3000 and I feel sensible investors should dig a little deeper on some of the claims being made.

Personally I was hoping that Professor Ralph would add some scientific backing to this theory in the recent seminar/webcast...but alas he didn't cover it.

Also I'm not sure the FM57 clinical study actually did any research into how MED3000 actually works (MED3000 wasn't actually a product at the time). So the phrase "Research has shown the cooling from the evaporation of these specific combinations of solvents, with subsequent warming, following topical application of the MED3000 gel stimulates the required physical response in order to achieve an erection." - which came verbatim from the FUM website today - shouldn't be suggesting that the FM57 trial investigated the MED3000 mode of action.

Parmx, wouldn't they need to know how it works to get a patent? Perhaps FrankMu (who has some experience on applying for patents) can comment here.

Ideally they will find out the mode of action - backed up by scientific evidence from someone like Professor Ralph. Once they know how it 'actually' works they can possible optimise the formulation of MED3000....and it will presumably aide their patent application(s).

MED3000 works through an evaporative and unique mode of action.  MED3000’s combination of volatile solvent components creates an evaporative and novel action that stimulates nerve sensors in the highly innervated glans pen1s rapidly leading to smooth muscle relaxation, tumescence and erection.

1. Application of gel:
Combination of solvents including volatile solvents.

2. Seconds later:
Volatile solvents evaporate.  Rapid cooling from the evaporation of these specific combinations of solvents, with subsequent warming stimulates nerve sensors in the highly innervated glans pen1s.

3. Minutes later:
Smooth muscle relaxation, tumescence and erection. Begins to work immediately for some patients and for 60% within 10 minutes.

Has anuyone else noticed the change in the wording in recent FUM communiques...I think I spotted it in the last RNS first. It seems to have been applied to the website too.
Perhaps our emails to the company on patents made them review their wording.

The confusion about MED2005 & MED2003 patents needs to be looked at IMO. Perhaps I will send them another email.

I have never ever said that Professor Ralph is untrustworthy. A long time agoI said that Professor Ralph has worked (indeed he is currently on one of FUM's advisory boards) for Futura. I was pointing out that when he comments on MED2003 he is not doing this as an entirely uninterested party...indeed he has declared in a scientific report that he has a 'conflict of interest' where Futura Medical is concerned. He does however have an international reputation and I doubt he would say anything incorrect or that would tarnish his academic image....so in that respect he is trustworthy. But investors need to know who people are when they make comments about a product or service...after that people can make up their own minds.

When did I say that he is on the payroll. He receives payment (I would expect) as a third party contractor or key advisor.

I cannot undrstand why some people on here want to pretend that Professor Ralph has no working links with FUM. I would have thought that having help & advice from a world renowned ED academic is something to advertise, not hide & deny like it's somehow seedy & underhand.

Tombi, you're wrong again. He deserves more respect and you should address him by his proper title.

Professor Ralph has worked for Futura Medical. Futura Medical have paid professor Ralph for work undertaken. Professor Ralph currently sits on one of Futura's advisory boards. Professor Ralph may well do work for Futura Medical in the future.

It must be my imagination - unlikely because I don't have one - but has the wording on FUM's website changed recently regarding Dermasys patents?

The use of "DermaSys® is a proprietary patented transdermal technology" has 'almost' disappeared. I can only find one headline that says: "DermaSys® - Our unique patented transdermal technology platform"

Under the section: "What is the full IP position of DermaSys® Technology and all its formulations?" Answer: DermaSys® is a proprietary transdermal technology platform with very strong IP offering a high level of product differentiation compared to existing marketed treatments.

There seems to have been a review on the wording of how Dermasys is patented, although they do say it's patented, it is much less prominent...almsot gone.

Also somewhat confusingly they are mixing up the patents of MED2005 and MED2003. The MED2005 GTN formulations do have patents....but I don't know if they are applicable to MED2003. I would suggest they aren't relevant to MED2003 in any way and as such MED2003 doesn't have any current patents (the patent is pending).

Seems to be some word games going on. It may confuse some investors who don't know much about Futura Medical but it is unlikely to pass investigation by potential commercial partners (assuming they are interested in the IP of FUM's products...maybe not).

LSE do seem to have gremlins at the moment...makes life more interesting!! But of absolutely no use to investors who want accurate up-to-date information, but I expect we all rely on other sources for that!!

There could well be several commercial partners. A different partner & contract for each region. FUM have been caught out before having all their eggs in one basket.

Potentially that could lead for a bidding war for FUM as the partners fight over the company...think of that. Now I'm clutching at straws!!
