Subject: Update
Dear Sir/Madam,
This is in continuation to the our disclosure dated January 19, 2023 in relation to a communication received from the 'Office of the Director General of Audit' dated January 18, 2023, in respect of conduct of Audit of License Fee paid / payable to the Ministry of Information and Broadcasting ('MIB'). Vide the said communication, the Company had informed that MIB has proposed to get the audit of License Fee paid/payable by all the Direct to Home ('DTH') Operators to MIB under DTH License Agreements conducted through the office of Director General of Audit and that the Company shall send appropriate response to the same since the matter relating to quantum, definition, applicability and levy of License Fee is sub-judice before the appropriate Courts.
In this regard, basis an Application filed by the Company in a Writ pending before the Hon'ble High Court of Jammu & Kashmir and Ladakh at Jammu ('the Hon'ble Court') in relation to DTH License fee, the Hon'ble Court, vide Order dated March 2, 2023 (delivered on March 9, 2023), has directed that the Company shall not be subjected by the MIB to suffer account audit by recourse of article 3.1.3 of as intended by the communications issued from CAG's end till further orders.
