Response to allegations made by Southern Environmental Law Center (SELC) in regard to activities at Lumberton
The Directors of Active Energy, the London quoted international biomass based renewable energy business, have filed a Motion to Dismiss the pending US federal court litigation in which SELC, representing a non-profit environmental group, alleges that AEG is discharging wastewater without the required permits, allegations that AEG strongly refutes and denies. The facts conclusively show that the only wastewater discharge activities which AEG is involved with have been fully authorized. SELC knows the allegations contained in the US federal court litigation are false. Given that, in addition to seeking to have the US federal court action dismissed, AEG intends to seek sanctions against SELC for having failed to conduct a reasonable inquiry as to the facts and/or law prior to filing this suit.
AEG has consistently worked with all North Carolina state agencies to secure and operate under all applicable permits that affect the Company's activities at Lumberton. AEG will continue to ensure that all operations at the Lumberton Site are compliant, including the forthcoming CoalSwitch™ plant once completed.
AEG looks forward to the successful resolution of the claims made by Southern Environmental Law Center and continues to work with its partners in North Carolina and Robeson County.
