Your WUP was made on 25 Oct and it looks as though those shares were exercised after 25 Oct. Perhaps you need to ascertain this, don't accept any money now produced as in effect, it could be in breach of your of your own WUP! It looks to me as though they're urgently trying to raise cash to make you an offer, but the date those shares were exercised needs to be ascertained first. my views.

Bobbybingo you are wrong, you do not understand about the process of service.

The compamy operates its registered office from a mail box address which is either a letter box in a wall or a concierge service.

If no one was there, which is highly likely given this lot, then the process server can leave at the address as a last resort, which means they could have it to the concierge person who would be in charge of mail for the company or they could put it in the letter box, or if there is one, pin it to the office door.

As I have said, it's imperative the WUP is served quickly and efficiently, so bearing in mind that Gowlings might well have issued and then got someone to go straight away from the High Court to serve, if service was to be in person and not by electronic means, then it is likely it was 'served' on the 25th Oct, which means the earliest the notice can appear in the Gazette is Friday. The date CS saw it is immaterial, as that cannot be relied upon as the date it was actually served on the company. It may have been pinned to their letter box, door or handed to a concierge, two days earlier! The only proof will be in the certificate of service which will be filed with the court and that will show the date, how it was served, and who, if anyone, it was served upon. End of, but stop misleading people, none of us know when it was actually served and the certifiate of service document will confirm.

Read about service and the CPR bobbybingo. I've served countless documents, and it's imperative to serve as quickly as possible in such circumstances as this, so that any assets can be preserved and not removed from the jurisdiction and so on.

Bobby, have you physically seen the certificate of service? until that appears on the court file us mere mortals don't know what date it was served. As I have said, I would have served it the same day that it was issued so it was effective immediately. You cannot rely on what the company tell you, I've explained that already, it could have been served by being left at the address but CS didn't see it until several days later. The certificate of service document is the only one you can rely on when that is filed as that will give the date of service and where the document WUP was served.

Are they actually lawyers or just some claims outfit? and we won't go there with that, as there is a certain individual that both Scuba and I know about who frequents these forums who is about as shady as they come in forming spurious claims companies, passing them off as legitimiate solicitors firms when they are not, and then using monies obtained from very angry clients who never hear anything towards other ventures including vodka bottle passing off cases! has that finally been heard yet? all my views of course!

You cannot mix your own money with client money, they must be held on separate accounts, so you cannot transfer monies to pay someones fees and then transfer it back again, your mixing up the office and client accounts and that's a definite NO NO! I think I'll screenshot that one!

The company can't sell any assets, a WUP has intervened, what do you lot not get? to sell any assets now, they need permission of the High Court Judge, who will also be aware of the Queeld case, and will likely injunct any monies/assets until the WUP is determined at the very least. If they have so much as tried to dispose of any assets, knowing that the WUP was forthcoming, a Judge will hammer them. They only have one option which is to pay Gowlings claim in full including the added costs. They can try and get an emergency hearing to injunct the WUP, but a Judge isn't going to have much sympathy with them as they should have dealt with it before it got anywhere near this far on, and it isn't a good look for the company for the forthcoming Queeld case, and tongues wag in courts. That ad will go in the Gazette probably in the next 48 hours, the bank accounts will then be frozen, and the Court will probably expedite the hearing and bring an end to it all. Will save court time on hearing the Queeld case for a week next week that is for sure and Judges always like that! It means they can leave early to go to the country on Fridays!!! (tongue in cheek!) :)

Something has occurred today on the Queeld case. I suspect either Queeld and Mispare have been advised to piggy back on the back of the WUP of Gowlings as there's now no hope of that hearing taking place, or Simmons and Simmons have asked to be removed from the Court record as acting for the company. How can they now act on behalf of the company when they know they've failed to pay Gowlings and are possibly insolvent? I suspect the company already know their chances of winning Queeld and Mispare is slim and I said this months ago. I said they would be best to settle it as a damage limitation measure, but no, they haven't, and more than likely because they haven't got the funds to do so. The Board have bled the company dry from the UK end, and you have to ask, was that always their intention, after raising 35 million or whatever hefty amount it was? I have my own views on that. my views as always but quite frankly, it stinks. And if by some divine miracle they do manage to persuade a Judge that they can pay Gowlings off, who on earth is going to trust them now? absolutely no one. imo.

I suspect Sinosteel are long gone, the war will have likely nullified the contract, and with all the litigation, I can't imagine for one minute they will want to loan any money!
