TC yes but in order for the company to be in a position to activate a sale they need to have the buyer in place with the offer, your saying that’s incorrect hence the buyer is ready to trigger the deal but that is an assumption as a binding deal has not been confirmed by the company?
Until a binding offer is confirmed it is the buyers remit to decide wether or not to peruse the deal (for example post DFS). EUA or the BoD and the shareholders can only celebrate a deal once a binding deal is confirmed authorised by the RF and the wonga winging its way to the bank.
And after all that if the company does not need to raise until July’s AGM then you are saying EUA has enough cash to last for the next 7 months (I agree with you). The company cannot simply raise unless it’s via EGM prior to the next AGM in July.

The company would need a 75% SH majority to raise, they most definitely matter!

The buyer is the one that needs to fess up if they are serious about purchasing asset(s) the BoD should have the DFS authorised by the relevant authorities by March latest then in theory the buyer should be in a position to have studied and confirm a price they and the BoD are happy with.

The BoD do not have a remit to authorise a raise I don’t understand why people think this is a option or requirement as it simply cannot be done without an EGM and after that they will need if I remember we last time out 75% of the vote, not an option anywhere near the table IMO.
