I strongly believe that the FCA’s ‘shareholder’ comment is aimed squarely at the BOD and their LTIP, not the casual shareholder. This is about public perception and the FCA want to walk out having made a gain in court.
Regarding their non-attendance.
1. Counsel are the representative of the FCA and Amigo, and are the only ones who can speak in court.
2. I presume the FCA sent a representative to the initial hearing (happy to be corrected) but won’t attend next week. This suggests they are either extremely confident with their opposition case, or they feel it’s pointless going. I see it as weakness and an acceptance of the inevitable. If I was in that position, with even the slightest chance of victory, I’d send a rep in case anything required clarification on the day. I’m pretty sure Amigo will have someone present.
I’m in the ‘we’re going to win’ camp.
