Watched the hearing. BP’s only real argument is that they want their share of the $56M, no interest in restructuring of any sort, nor suggesting that they had any interest in bidding. Nothing to suggest that they will be a knight in shining armour for us, nothing.

Summit’s lawyer talked of restructuring and potentially eliminating millions in ‘bond debt’. We’ll wait to read the transcript, but restructuring a recurring topic, with the ability to remove ‘bond debt’.

BP’s primary motivation here was to get their money back. As a secured lender, they believe they should have benefited from the stalking horse bid, they did not. They also stated that the SISP should have run for longer, with a lower stalking horse bid to generate interest and stimulate bidding. They were offered the chance to participate in interim financing, they declined.

There is nothing to suggest that BP want a renewed SISP process in order that they can then outbid Summit themselves, this suggestion has been put forward with no basis.

It’ll be interesting to see what happens, but let’s all be careful what we wish for, and question what we listen to. Don’t just listen to what’s being said, ask yourself why it’s being said.

As stated a couple of days ago, CAG did everything it could during that period to gather as much information as possible. Although we cannot discuss the details, we are one of only a few parties who managed to gain access to certain information, info not shared publicly. Due to actions we took at this time, we are now in a very strong position - and the ‘opposition’ know this. What you are seeing here is ‘spin’ worthy of Alistair Campbell himself. It’s very easy to read things into such statements, they’re designed to make you do just that. The truth usually lies in what they specifically do not say, in clear language. Why use 100 words to suggest something, when you could easily state a fact using just 10?

One thing that this increased reference to CAG shows (and that now includes the hundreds of shareholders signed up to the class action), is that we are now a recognised component. We know a lot, and they know we know it.

We will continue to support Mr Cotter by sharing all we know, then simply allow him to do what he’s exceptionally good at.

CAG have had discussions with several parties, over several months. Everything was always noted for future use. We may, or may not have had access to the data room, but there was never any possibility of CAG bidding. Everything we have done was with a view to gathering evidence and we have done so to a degree that places us well for our future action. Under instruction from Mr Cotter, we will NOT be discussing any of the far reaching information that we are in possession of, but we feel we’re in a very strong position.
