Eggy, they're working with the FDA on the trial design, the next phase is a registrational study, again, with the FDA. I imagine they know what they're doing. I doubt that the FDA are sat there, clipboards in hand doing nothing other than coming out with stupid statements like "you'd need to run a large scale trial to be sure".
