I think they will win their case...that's why I'm here.
However I can be wrong, and have been on many occasions.But I always know the risks of being so.

Capx have no funds, they are surviving off a A$1.7m credit line.

Please explain, happy to hear how your experience can say that my thoughts of, if the company thought there was any chance they would lose this case they would take ANY litergation terms offered...
Losing the case will basically be the end of the company...
Any plan b is better than no plan b.

BOTH statements say "we are 100% sure of success".

The decision could drop anytime now.
Just one element of doubt in Maxwells claims and the judge will halt proceedings and decline summary judgement.
So am hopeful of conclusion before Easter weekend...
The longer with no news indicates a stronger case for Maxwell...imo.

So what happens if the judge agrees with the judgement summary?
No going to trial.
Cap-xx are running on empty.
No future license agreements.
Might not be over for Cap-xx...but for current holders it will be as good as.

But if its denied....

I have a rental portfolio...
I have not increased rents in 15 yrs....I have had the good times with the low rates, I was lucky.
This month after years of not missing payments 2 tenants have only part paid...stating they are struggling financially.
The effects of high rates have not started yet...

IF the Judge declines then maybe a settlement.
IF he approves then basically Cap-xx case over.

Why would the Prof consider other projects, they have the Finland PLs and a PL in County Clare.
They have enough on their plate...I just think it was a subtle attempt at saying...money no problem...imo.
