Morning Victor,
I'm with you on your analysis of the outcome.
I think this comes down to integrity and professionalism.
PCIP have challenged Sycurio's integrity:
Prelims - 6/9/22
"We believe that the claim was brought against us by Sycurio, shortly after they were acquired by a US-based Private Equity fund, primarily to try to disrupt the delivery of our growth plans."
Here's an example PCIP's professionalism:
Annual Report - September 2021
The Group utilises several IPR protections such as patents, copyrights, knowhow, and contractual provisions for both partners and customers, as well as with current and from employees and contractors
Additionally, the Group invests time with specialist IP and Patent law firms in both the UK and US to ensure it does not infringe third party IPR
To counteract the risk of third parties infringing PCI Pal’s own IPR, or claim that PCI Pal has infringed their rights, the company regularly reviews its propriety software and development activities with its IPR lawyers. As such the Directors do not envisage the risk of loss or infringement to be significant
Annual Report - September 2022
The group designs its systems so as to not infringe third party owned software and IP. Where necessary the group will enter licence agreements with the owners of IP to allow use within our systems. The group is currently subject to a claim for infringement of a patent. The directors have thoroughly reviewed the claim and believe it unfounded and so are defending the claim vigorously. As part of the legal review process the directors have thoroughly reviewed the existing systems and are confident in the unfounded nature of the claims.
This professionalism backed up the patent office in the USA:
Patent grant - 22/3/22
"During the patent application process, in addition to the U.S. Patent Office's own prior art reviews, PCI Pal referred a number of competitor patents to the patent office for review. These included all U.S. patents owned by Semafone Limited."
