Pyro there are two issues here that like you have done tend to merge.
As I posted on the morning of the first RNS the two could be related but do not need to be. There is simply insufficient information to come to a conclusive answer.
As I posted this morning the communications lockdown since April lifted by what was perceived by many to be bad news at UD2 has just amplified the noise and cynicism.
Equally as I have posted previously the August payment was always the most likely ones to be in shares.
It's entirely possible for Frontera to be flowing and selling train loads each month and still have this dispute if the heart of the problem was the price of the August conversion. If they are then this will end with FRR paying the $2.6m in cash and walking away having shown up YA for what they really are. That is a distinct possibility. If they are not the cash will have to come from somewhere/someone else or they just effectively stonewall YA. If they then try to enforce it in court then as with outrider Frontera will just counter claim and it will ultimately settle in a mediation. However, I doubt it would get that far if we have other hedge funds who would happily take the shares rather than give them to YA.
I think the crash down to 0.0022p just in time for the payment is a factor. They might have got away with a higher conversion price but I don't think they should be allowed to benefit from the effects of shorting.
I do have to say that I think there are people who post on this board who traded during that period who have directly contributed to this problem.
I still strongly suspect the dispute started from the shorting to push the price down and has since escalated. The 2 week delay in the RNS leads me to believe Frontera were trying to sort it out quitetly but relations with YA have broken down.
Good flow rates announced into the market will resolve this one way or the other. They have to be out there by the Oct meet probably with the accounts. Bad flow rates and the future campaigns will struggle to be funded and options become narrower. As I said it's a coin toss and YA have already called their side. The quicker they are removed from the board here the better.
