Smann - he was referring to "Condition A: the company has encountered, or is likely to encounter, financial difficulties that are affecting, or will or may affect, its ability to carry on business as a going concern" he wrote
"The threshold for Condition A is, however, relatively low. It is enough that the Company is likely to encounter financial difficulties that may affect its ability to carry on business as a going concern. I am satisfied on the basis of the extensive review undertaken by PwC that this threshold is met"
So yes he agrees thatthe PwC Report shows there is a problem but he alo wroye
"These are all matters which, if properly evidenced at the sanction hearing, would be relevant to the exercise of the court’s discretion. In particular, the extent to which there is or might be value in the shares in any relevant alternative is likely to be of importance in determining whether it is appropriate to sanction a Plan that results in the current equity being diluted by 95%."
So the assumptions can be tested in court later
