RE: How US court deal with Cineworld is UK company?13 May 2023 16:09
Hexam - If that was the case, that would mean any company during a financial crisis can say, okay we are struggling to pay our debts so what we'll do is print new shares, cancel the old ones, and continue trading under the same name. That's impossible, they would have to first wrap up the old company before creating a new one. If the new company will have a different name then they can just cancel the old shares and issue the new ones, but if they continue to trade under the same name, the old shareholders will have to be included.
So imo one of two things will happen here. Either they will go for the option I just mentioned and include the old shares via a share quota, or they will go private and pay off the current shareholders at the current share price. The company is currently valued at 12M, so paying off current holders would be no problem for the new company.
