The patent term extension is based on the time the product is in clinical testing and regulatory review. A patent term may be extended for a period of time that is the sum of one-half of the time in the testing phase, plus all the time in the review phase.3 However, the extension period is reduced if any of this period occurred prior to the patent's issuance or if the applicant is found not to have acted with due diligence during clinical testing and regulatory review. The patent term extension cannot exceed five years. The total patent term including the extension cannot exceed 14 years following regulatory approval.
