Tanzania Tightens Rules on Foreign Involvement in Small-Scale Mining Licenses 🇹🇿
In a major regulatory shift, the Government of Tanzania, through the Ministry of Minerals, has introduced new rules to manage the involvement of foreigners in small-scale mining licenses (PMLs).
These licenses, under Section 8 of the Mining Act (Chapter 123), are designated exclusively for Tanzanian citizens. However, Section 8(3) allows local license holders to engage foreigners through "Technical Support" agreements.
Speaking during the Ministry's 2024/25 budget presentation, Minister for Minerals Hon. Anthony Mavunde revealed that a surge of unregulated foreign participation had undermined the intended benefits for small-scale miners, leading to disputes and missed opportunities for capacity building. To address this, the government has now formalized the process through new regulations.
Effective from April 25, 2025, following Government Notice No. 260, the new regulations require:
Mandatory registration of all Technical Support contracts with the Mining Commission.
Clear definition of "Technical Support" to ensure it genuinely enhances production efficiency and skill development.
Revenue sharing frameworks between license holders and technical support providers for any minerals extracted.
This move, a direct response to directives from H.E. President Dr. Samia Suluhu Hassan, aims to empower Tanzanian small-scale miners, enhance transparency, and foster sustainable growth within the sector.
