Mijas - I think an excellent cut & paster is a more accurate description of me! My opinion is "bewitched, bothered and bewildered, am I" I think we all realistically expected this might not go our way, so - sadly - no surprise there. But even now, things are far from clear cut. The GOGC statement isn't bragging about vindication etc but states "The Arbitration Tribunal has upheld the Claimants’ interpretation of the contract and satisfied a vast majority of the claims raised by JSC Georgian Oil and Gas Corporation and LEPL State Agency of Oil and Gas of Georgia. Among the issues decided by the Arbitration Tribunal, it ruled that the Respondent - Frontera Resources Georgia Corporation committed material breach of the contract by refusal to relinquish and return to the State the exploration area, which represents almost 99% of the entire contract area." So not a total slam dunk for the GOGC?. Part of me thinks FRR might have been happy to give up the 99%, the arbitration was to decide on what terms. Neither FRR nor GOGC have explicitly detailed the in and outs of the arbitration case. There is no mention of sunk costs. We have talked endlessly about the movement of the asset - seems no specific mention here.

Did FRR withdraw the counterclaims either because they had no likelihood of success, or are Ok to accept the terms of the arbitration so no need to proceed (though GOGC claim these where thrown out anyway)

The last sentence ends with "(GOGC) are considering further steps aimed at enforcement of the award and implementation of the rights and remedies granted under the contract.

As always with FRR - more questions than answers. One big door seems to have been shut in our faces - we wait to see if other doors will open for us.

RE: 1%
Not the outcome any holder wanted but a few months back Oppsi did indicate that FRR had a poor case and change of lawyer at a critical stage was not good. FRR is a dire position and any good legal rep would have told them this. If we are left with !% or so of the developed field this is where most of the data has been gathered. Has the ongoing payment to lobbyist been aimed at GG to ensure an extension is granted (as these Lobbyist would have no impact on the arbitration). If so this will have a significant value.
Now with the looming debt repayment and now an additional 6Mil to find FRR will have to file for full bankruptcy or sell out what is left (it is the prime plot) and the data will be of value. Going alone is not now viable.
We do need the BoD to put out a statement asap.

The outcome of the arbitration still is not totally clear...… ok if we have 1%, where is this? What consideration has been given to the tax owed by GG to FRR? Any consideration of the political interference? Has all the 'conversations' between US officials actually left the company with a small something ( with reasonable value )? We must still own the data and knowledge of well performance? With our 1%, has that now been extended beyond 2022 say for 25 years? Zaza must now communicate!
Finally, a clue...…..? "Currently, JSC “Georgian Oil and Gas Corporation” and LEPL “State Agency of Oil and Gas” are considering further steps toward implementation of the decision taken by The Arbitration Tribunal and accomplishing other RIGHTS GRANTED by the contract".

To me it looks like we are just returning the undeveloped areas that are in block 12, hence the 99% return.

Term
The Block 12 PSA has a twenty-five year term which will expire on 13 November 2022. The term
includes an exploration phase which will expire on 13 November 2017 (the “Exploration Phase”). If
commercial production remains possible in relation to any part of Block 12 which is specified in a
development area or areas under the Block 12 PSA (“Development Areas”), Frontera Georgia is
entitled, after the expiration of the Block 12 PSA, to receive an extension of the term of the Block 12
PSA and the Mineral Licence regarding such Development Areas for a further period of five years (or
the production life of the Development Area if this is shorter).

Relinquishments
Save as otherwise agreed between Frontera Georgia, the Agency, and GOGC, Frontera Georgia will
relinquish its rights to Block 12 in respect of any area outside of any Development Area at the end of
the Exploration Phase.

Just for perspective, Block 12 is 5060 square Kilometres and Taribani is 80 square Kilometres. Therefore, Taribani represents 1.58% of Block 12. It is possible that some of this area is not within the development area and some of Mtsarekhevi and Mirzaani are included.

Georgian Oil and Gas Corporation and State Oil and Gas Agency win lawsuit against Frontera

On April 17, 2020, the International Arbitration Tribunal, on the one hand, on the final disputes between JSC Georgian Oil and Gas Corporation and the State Oil and Gas Agency, and on the other hand between Frontera Risorz Georgia Corporation and Frontera USA. A decision was made to share the products of June 25, 1997 I. The distribution and study of the processing plant is based on the contract.

The Arbitration Tribunal supported the interpretation of the norms of the contract by JSC Georgian Oil and Gas Corporation and the State Agency for Oil and Gas LEPL and satisfied the absolute majority of their claims.

Among other things, the Arbitration Tribunal ruled that the Frontera Risorz Georgia Corporation had substantially violated the contract, which was a refusal to return the search area (99% of the entire licensed area) to the state.

According to the decision, Frontera was instructed to reimburse the fee paid by the JSC Georgian Oil and Gas Corporation for the use of natural resources and also to reimburse the plaintiffs for the costs of arbitration proceedings. The Arbitration Tribunal also upheld the claims of Frontera Riverside Georgia Corporation and Frontera USA and demanded that the proceedings be adjourned. According to the contract, the decision of the arbitral tribunal is final.

Currently, JSC Georgian Oil and Gas Corporation and LEPL State Oil and Gas Agency are considering further steps towards the implementation of the decision issued by the Arbitration Tribunal and the implementation of other rights granted by the contract.

Negative WTI oil price
WTI crashed 300% to minus $37/bbl earlier, where oil companies were paying companies to take the stuff away, to avoid paying storage costs.

Brent is still over $26/bbl and Block 12's oil sells at a $5 premium, with less than $12/bbl costs. Still plenty of profit to be had at the lowest price point ever in crude trading. Block 12 will produce for decades and the oil price unlikely to be this low in the future. IMHO Uncle Sam will put tariffs or sanctions on the KSA's oil or the KSA. The KSA has had too much power over the POO for far too long, but the world needed their oil. Prior to the COVID-19 crisis the world's production of oil was 80.6 million barrels per day, with the KSA producing 12 million barrels per day. Now with forecasts of reduced demand by 20-30%, the world could now survive without oil from the KSA. Also, WTO dumping rules may provide legal reasons for possible sanctions. Therefore, the stockpiled oil, plus room for increased production in the US and Russia, could provide a buffer as demand increases after COVID-19. IMHO as the cheaper oil from the KSA is still on route to the USA and the PRC, until they have possession, they're unlikely to show their hand.

That appears to be the contents of doc. 38, with the addition that the Joint Pretrial Order has now been given a scheduled date of 05/03/21, presumably by the judge. There is a further comment (again with no formal document numbered), stating that a previous Scheduled Conference date of 14/05/20 (as mentioned in doc. 37), has now been 'terminated'.

Oh my, it seems a bureaucrat somewhere is having fun. Dear me.

Scheduling Order

This is a form, which looks like it hasn't been fully completed, which contains the dates for the trial schedule. It says :-
The plaintiff's (I think that's OMF) experts will be named with a report furnished by 30/09/20.
The defendant's (SN & ZZ) " " " " " " " " " 30/10/20.
Discovery must be completed by 15/12/20. (There is also a note stating that Counsel may agree to continue discovery beyond the deadline, but there will be no intervention by the court).
Dispositive motions will be filed by 15/02/21.
Non-Dispositive " " " " " 15/03/21.

The form then has spaces for dates to be provided by the court (presumably later than the above dates) for a joint pretrial order, a Final Pretrial Conference, and a date set for the trial.

No judge's signature is shown to be affixed to the form, so I suppose we'll have another document later showing her approval of these arrangements.

Why 2m social distancing even when masks are worn?

Now I have the answer, it's because satellite technology cannot separate people as it's only accurate up to 6 feet. Therefore, in a future surveillance world, governments will need people to get used to keeping in excess of six feet apart, ie. 2m = 6 feet 6 inches. The WHO's handling of the situation has also given cause for concern. They didn't pass on the warning from Taiwan; they dismiss the use of Chloroquine (see BBC extract below); and the WHO states 'There is no evidence that the Bacille Calmette-Guérin vaccine (BCG) protects people against infection with COVID-19 virus.'

Chloroquine, and a related derivative, hydroxychloroquine, have gained attention - despite the World Health Organization (WHO) saying there is no definitive evidence they work.

Secondly, the same BBC article states that Chloroquine works in blocking COVID-19 in lab studies; that there are more than 20 clinical trials being carried out on the treatment of COVID-19 with Chloroquine; but that there are also risks of serious side effects from Chloroquine, including renal and liver damage.

Finally, there is research showing that the BCG reduces the chance of contracting COVID-19 six-fold, which appears to be backed up by cross referencing the statistics of countries cases with their BCG vaccination stance. I can understand caution in the use of the BCG as it is a live virus type of vaccination, which could cause TB in people with a weakened immune system, but IMHO the WHO needs to be more open.

Why has Ecuador had a massive surge in deaths? IMHO it is because unlike other Latin American countries or economically less developed countries in other parts of the world, it is the only one to stop it's BCG vaccination program (see figure two in the link below).On the map in figure two it sticks out like a sore thumb as the only purple shaded area in South or Central America, Africa or Asia.

IMHO this looks like more proof of a link between COVID-19 and the BCG.

There are a lot of very poor countries around the world, where it would be expected that COVID-19 would have a much higher number of cases and deaths, but as yet this hasn't occured. The list of countries still vaccinating with the BCG compared with the list of countries COVID-19 statistics, seem to back up the theory of the BCG reducing the chance of the virus six-fold.

IMHO the WHO under Timid Ted's leadership doesn't have the bravado or the confidence to take the difficult decisions with the COVID-19 pandemic. While the research hasn't been peer-reviewed, even if the results are half right, that could amount to three times fewer cases. IMHO the sheer magnitude of the difference in the number of cases warrants the immediate use of the BCG for front line staff (I'm surprised it isn't already mandatory for health workers). Plus research has shown that the BCG offers some 'beneficial effects against non-related infections' and 'protection against non-related viral infections.' (see the two extracts from the link below).

'In conclusion, BCG induces epigenetic reprogramming in human monocytes in vivo, followed by functional reprogramming and protection against non-related viral infections, with a key role for IL-1ß as a mediator of trained immunity responses.'

Summary

There is no evidence that the Bacille Calmette-Guérin vaccine (BCG) protects people against infection with COVID-19 virus. Two clinical trials addressing this question are underway, and WHO will evaluate the evidence when it is available. In the absence of evidence, WHO does not recommend BCG vaccination for the prevention of COVID-19. WHO continues to recommend neonatal BCG vaccination in countries or settings with a high incidence of tuberculosis.1

There is experimental evidence from both animal and human studies that the BCG vaccine has non-specific effects on the immune system. These effects have not been well characterized and their clinical relevance is unknown.2,3

On 11 April 2020, WHO updated its ongoing evidence review of the major scientific databases and clinical trial repositories, using English, French and Chinese search terms for COVID-19, coronavirus, SARS-CoV-2 and BCG.

The review yielded three preprints (manuscripts posted online before peer-review), in which the authors compared the incidence of COVID-19 cases in countries where the BCG vaccine is used with countries where it is not used and observed that countries that routinely used the vaccine in neonates had less reported cases of COVID-19 to date. Such ecological studies are prone to significant bias from many confounders, including differences in national demographics and disease burden, testing rates for COVID-19 virus infections, and the stage of the pandemic in each country.

The review also yielded two registered protocols for clinical trials, both of which aim to study the effects of BCG vaccination given to health care workers directly involved in the care of patients with COVID-19.4,5

BCG vaccination prevents severe forms of tuberculosis in children and diversion of local supplies may result in neonates not being vaccinated, resulting in an increase of disease and deaths from tuberculosis.6-8 In the absence of evidence, WHO does not recommend BCG vaccination for the prevention of COVID-19. WHO continues to recommend neonatal BCG vaccination in countries or settings with a high incidence of tuberculosis.
