No the judge actually said if you are too busy to reconvene I will send out the verdict in writing within a couple of days.

He said he would try to reconvene with the qc’s but if that couldn’t happen it would be submitted in writing.

Is there any case law in the land on this type of matters where the judge comes back and says. Sceme rejected, but I will approve it on these terms? That is not in question. Is the scheme fair and reasonable. Were the procedures followed? Did the fca have prior time to interject? This is what is in question. It’s yes/ no. Approve/ throw out. That’s it.

At last- a post with sense. The fca actually brought nothing constructive apart from why they feel it isn’t fair. Whilst I appreciate that this was their job, as a judge I would want to see something constructive to avoid a repeat performance, the next time we get to this stage. Otherwise it will happen again and how is that legally fair on customers that voted 95% yes
