I think he means that there may not have been a legal necessity to consult with shareholders but they should still have done so because there was no reason not to.

ADUk,I sympathise with your thoughts but the main element of the previous plan was a conspiracy between the old BOD and the Bondholders(which may include Kerogen's proxy).Now the 2 major shareholders have swapped places in the hierarchy and CA effectively control the BOD.If CA have plans to takeover HUR they will need a much more cunning plan and will have to pay much more for it

Having read the CA document I am quite optimistic that the hearing will be postponed.There is no urgency for a rushed meeting so the most reasonable conclusion will be to delay matters for all sides to present their case in detail.
