Maxwell Techs. Inc.'s motion to dismiss, in CAP-XX Ltd.'s action against Maxwell for the infringement of two patents for a charge storage device, was denied by the federal district court in Delaware. The court found that (1) CAP-XX has pleaded facts plausibly establishing that specifically named Maxwell products meet the volumetric FOM limitations claimed in the patents, and (2) CAP-XX has alleged facts to plausibly establish that an accused Maxwell product meets the limitations of the exemplary claims of each asserted patent.
