Fraud Act 2006 2:2 states:
(2)
A representation is false if
.
(a)
it is untrue or misleading, and
.
(b)
the person making it knows that it is, or might be, untrue or misleading.
Lets focus on "the person making it knows that it is, or might be, untrue or misleading"
now let us consider the statement "10 years of development culminates in this moment, where the first production model of the Flow boiler rolls off the production line" A jury would have to consider whether a boiler that was noisy, self destructive and produced hardly any electricity was in any way a "production model". Given evidence exists it was never produced at all around November 2014, then I suggest a jury would logically conclude the use of the term "production model" was misleading and that the boiler was still in development. Further, If we consider the financial incentive of pumping the SP to over 50p was, let us suppose , a 2 million personal bonus to Mr Stiff, then the case is further strengthened. Next up is Chinese drawings, suppliers statesments and expert witnesses. Tiddly om pom pom eh?
